Menard to fly Wis. workers in to staff ND store

(AP) ? Home improvement retailer Menard Inc. says it will hire workers from its home base in Wisconsin and fly them to North Dakota to staff a store in Minot, which is near the state's booming oil patch and has more jobs than takers.

The company said in a statement that it plans to hire 50 workers in Eau Claire, Wis., where it has its headquarters, and fly them weekly to Minot, which is also in the middle of an unprecedented building boom as it recovers from record flooding last year.

Menard, which has more than 200 stores in the Upper Midwest, said this would be the first time it has ferried in workers by airplane, but it believes jetting in employees for weeklong stints and housing them in hotels "is going to be a permanent solution for as far as we can see."

Minot is North Dakota's fourth-largest city and had been growing rapidly even before the flooding that swamped some 4,100 homes and displaced thousands of residents. Its population grew from 36,500 in 2000 to about 41,000 in 2010, U.S. Census data show. City officials say the present population is nearing 50,000.

That means there's strong demand for building materials. Minot store manager Phil Graef said business is the busiest in the five years he's headed the store, the only big-box building supply retailer in town.

"We were starting to stay even with the oil boom, and then the flood happened," Graef said. "Now, we're trying to get ahead of both of those."

Finding workers to keep up has been tough, he said.

"Everybody has a 'now-hiring' sign in their window," Graef said.

Businesses struggle to attract workers throughout North Dakota, which has some 22,000 more jobs than takers and the lowest unemployment rate in the nation, at 2.4 percent, Job Service North Dakota data show. The unemployment rate in Minot is 2.3 percent.

"It's going fast and furious here," Minot Mayor Curt Zimbelman said. "As it is, there is not a big enough labor force around here, and as it gets colder there is less of one."

The unemployment rate in Eau Claire is 6.3 percent, lower than the national rate of 7.9 percent in October. Mike Schatz, the city's economic development director, said its economy strong and there are job opportunities in the town of about 65,000.

"It's not like people can't find work here ? there are plenty of expansions going on," Schatz said.

But Menard spokesman Jeff Abbott said there was good interest when the company held a job fair in Eau Claire earlier this month to hire workers for its Minot store. Menard intends to train the workers at Wisconsin stores and send them to Minot "as soon as possible," he said.

Menard has offered a starting wage of $13 an hour at the Minot store, well above the federal minimum wage of $7.25 per hour, which prevails Wisconsin. It's also the minimum wage in North Dakota, but most jobs there pay more. A listing for a pizza delivery driver in Minot was advertised Thursday at $15 to $20 per hour, plus a $250 signing bonus.

Competition for the Menard jobs has been tough in Wisconsin.

Pam Weaver, of Eau Claire, said her husband, Gary, had his heart set on one of the positions with Menard in Minot but was told Thursday that he wouldn't be hired. No reason was given, she said.

"It's frustrating," Pam Weaver said. "He seemed disappointed."

Gary Weaver, who was laid off from his job as a telemarketer several weeks ago, was back at the unemployment office Thursday filling out job applications, said wife, a 55-year-old claims auditor for a health insurance company.

"Who would have thought that we'd be in our 50s and struggling?" Pam Weaver said. "We're not the only ones. We've had three different friends who have lost businesses in town in the last five years."

Zimbelman, the Minot mayor, and Menards store manager Graef said they hope some Wisconsin workers eventually decide to make Minot their permanent home instead of commuting more than 500 miles by air to get there.

But Eau Claire's Schatz has another idea.

"We would hope just the opposite," Schatz said. "We want them to bring that North Dakota money back to Eau Claire."

WASHINGTON (AP) ? The government should require fire suppression systems in all cargo containers or compartments of planes to prevent the kind of ferocious in-flight blazes that have killed four cargo pilots over the past six years, federal accident investigators said Wednesday.

The National Transportation Safety Board didn't specify what kind of technology the Federal Aviation Administration should require airlines to install. But the board's letter to the FAA came a day after United Parcel Service said it has developed systems that can prevent or contain even fires in shipments of lithium batteries, which burn at very high temperatures.

Lithium batteries are suspected to have caused or contributed to the severity of the fire in the crashes of a UPS jumbo freight airplane in Dubai in 2010 and an Asiana Cargo plane off the coast of South Korea in 2011. In 2006, two UPS pilots were able to escape a plane shortly after landing in Philadelphia before it was consumed by flames. That plane also contained lithium batteries.

Current fire protection regulations for cargo planes are inadequate, according to the board's letter.

"These fires quickly grew out of control, leaving the crew with little time to get the aircraft on the ground," NTSB Chairman Deborah Hersman said in a statement. "Detection, suppression and containment systems can give crews more time and more options; the current approach is not safe enough."

FAA rules say airplane fire warning systems must be able to detect fire in a cargo container within a minute of its ignition. But the NTSB said its tests of two types of cargo containers showed a time lapse between ignition and detection ranging from 2 1/2 minutes to more than 18 minutes.

In the tests, the fires "grew very large, capable of causing significant damage to an aircraft" before they were detected, the letter said.

Current FAA regulations require halon gas fire suppression systems in below-deck cargo holds, but not in the main cargo compartment above deck. The main strategy for fighting fires above deck is to deprive them of oxygen by taking the plane to an altitude where depressurization is achieved.

In the case of the UPS plane that crashed in Dubai, however, there was a lapse of 2 1/2 minutes between detection of the fire and depressurization, which was enough time for the fire to damage the plane and affect the pilots' ability to control the aircraft, the NTSB said.

Also, halon systems don't work on fires involving lithium metal batteries, which are found in watches, calculators and a wide range of consumer goods.

Unlike other kinds of batteries, lithium metal batteries can spontaneously ignite if exposed to air. Also, the positive and negative poles in some lithium batteries are close together, leading more easily to short circuiting, which can cause a fire.

Rechargeable lithium-ion batteries, which power devices such as laptop computers, cellphones and MP3 players, are a fire concern, too. Fires involving lithium-ion batteries can reach 1,100 degrees, close to the melting point of aluminum, a key material in airplane construction. Lithium-metal battery fires are far hotter, capable of reaching 4,000 degrees.

The FAA said in a statement that it will review NTSB's recommendations. The statement noted that FAA has been researching alternatives to halon suppression systems for a number of years. A report two years ago by the agency concluded that the cost of installing fire suppression systems in main-deck cargo compartments was too expensive to justify requiring airlines to add them.

UPS said tests last month of a new type of cargo container it has developed showed the container can suppress and contain lithium-ion battery fires for as long as four hours , which is enough time in most instances for pilots to safely land the plane. The tests were conducted at the FAA's technology center in Atlantic City, N.J., with FAA and NTSB officials looking on.

The container is made from fiber-reinforced plastic akin to materials used in body armor and suits for race-car drivers. Temperatures during the test reached as high as 1,200 degrees, but a powdered flame suppressant released inside the container prevented most of its contents from being damaged, UPS said. The airline is also testing a new type of flame-suppressing cover for cargo pallets.

While the new technologies require further testing, "we believe they have the potential to revolutionize cargo safety," UPS spokesman Mike Mangeot said.

Separately, the FedEx Corp. has developed a fire-suppression system that, once a fire is detected in a cargo container, punches a hole into the top of the container and injects an argon-based foam capable of smothering a fire, as well as absorbing toxic fumes, officials for the airline said.

FedEx has installed the system on its Boeing 777s and MD11s, which fly long routes over water and to remote areas of the globe. "We will continue installation on our entire long-haul fleet," FedEx spokeswoman Maury Donahue said.

If you?re from the UK and you?ve ever watched the BBC series Dragon?s Den there?s a very good chance you?ll already have heard of the Tech21 company. The manufacturer?s products are all constructed from a material named D3O, which contains a very unique protective quality. The quality ? known by Tech21 as ?Impactology? ? essentially means that as it is hit, the particles tighten and the once soft and flexible material becomes incredibly hard. The harder you hit it, the harder D3O gets. In essence, it gets better at its job the more you subject it to. It?s pretty awesome.

I have to admit, I had one of the early Tech21 skins for iPhone 4 and was not impressed. The design and material meant it was a little loose. So, when they contacted me to ask me about reviewing the new range (just launched in the US) I was excited, but also unsure about what to expect.

The Impact Band is a bumper case with the added benefit of having a hard (but flexible) transparent back plate that?s removable. The case I got is a completely clear material, with the bright orange D3O running around the edge protecting all the corners. Not only does the orange vein add vital protection, it also adds to the aesthetic appeal. The bottom edge is pretty much completely exposed to the elements, thanks to a large cutout. The volume and power/lock buttons are all covered with specifically designed ?buttons? within the case. They can be a little hard to press at times, but not enough to put you off. Mute switch is easily accessible thanks to a well designed cutout with the perfect slanted edges to ensure you can stick any of your digits in there to switch the sound on or off with ease.

The Impact Band fits snugly around the phone, but it does add noticeably width to your handset. Texture wise, it?s an odd, semi-shiny and simultaneously sticky feel. A huge plus point is that ? in terms of resistance ? when you do use your grip to try and squash it, it has very little give and a whole lot of resistance. It gave me the reassurance that it was going to protect my iPhone with its life. Almost like my own iPhone bodyguard.

One part I almost dismissed as pointless turned out to be one of the elements I loved the most: the back plate. When I first put it on the phone, I genuinely thought that all it was for was to relieve my ?Scratchgateophobia?. Almost like an after thought, thrown in at then end. ?Just another clear plastic back cover!? Was my exact thought. And, to prove it (like any good reviewer would) I tried to break it by bending it, assuming it was a brittle material. I was expecting bits of hard plastic flying everywhere. Nothing of the sort. It bended. Needless to say I felt confused, shortly followed by sense of admiration. I even bent it double, with the top and bottom edges meeting, bracing myself for it to snap. Nope. The material didn?t even show any signs of disfigurement afterwards, no whitening where it had bent through the middle either. It?s not just an after-thought. It a stiff, shatter resistant, protective backplate. It may not look amazing on your phone, but it?s not going to break that?s for sure.

I found only two negative points worth noting. Firstly, the rubbery material left at the bottom edge (on the top and bottom of the cutout) is incredibly flexible. Although it?s not likely to break, it slips very easily and feels too loose. Sadly, I think that?s unavoidable without adding a hard material instead. Secondly, I?d love it if the volume and power buttons had a hard plastic cap, just to give it that more pleasing ?click?.

All-in-all, you get a whole lot of protection for your ?24.99 ($34.95) thanks to the revolutionary material and its qualities. Israel?s cosmopolitan capital has developed a reputation over the past decade for residents leading lives removed from the rest of Israel and the Middle East, but this weekend's rocket attacks from the Gaza Strip have burst the infamous Tel Aviv bubble.

Video footage showing bathers sprinting from a hotel beach on Saturday?with rocket intercepts overhead served as a jarring contrast to the city?s image as a destination for carefree pleasure seekers. On Sunday, Tel Aviv was targeted by two separate rocket salvos, though all of them were shot down.

Not only does Tel Aviv symbolize Israel?s capital city for business and culture, it?s also a city that symbolizes efforts by Israelis to maintain a sense of normalcy despite the daily feuding of the Arab-Israeli conflict. But now the new normal in Tel Aviv includes the opening of municipal bomb shelters to the public.

"People here hold up the banner of freedom," says Motti Haimovich, the owner of a French bakery in central Tel Aviv. "When there are rockets, then there isn't any freedom."

On the morning after the first siren last Thursday evening, weekend caf? goers at the Le Moulin bakery showed for their usual coffee and croissant to check in with one another, says owner Motti Haimovich. But when a siren sounded at the height of the midday rush on Friday, the caf? emptied quickly.

That type of blow to the daily routine is being held up by Palestinian militants as an achievement. For Hamas and other militant groups in the Gaza Strip the very success of placing Tel Aviv under attack ? even if there are no casualties ? is a symbolic milestone matched by no one else in the region since Saddam Hussein fired Scuds at the Jewish state in the first Gulf War in 1991. Because of that, many Israeli commentators say that the prime minister may want to prolong the fighting.

Israelis derisively refer to the city as "the State of Tel Aviv" to impugn it as a mecca for out of touch armchair liberals who still insist on pushing the peace process with the Palestinians. The plight of rocket attacks could remake the attitudes of Israelis who dismiss the city and its residents as na?ve peaceniks.

"Now maybe we are even," said Israeli author Etgar Keret, referring to the dividing lines between armchair liberals and mainstream Israelis.?"Now we can start talking." (The original version of this story misstated the source of the quote.)

Residents of Tel Aviv often are nostalgic about that period around the first Gulf War, which left the city virtually unscathed. They have more serious and pained memories of the second Palestinian intifada, which unleashed a wave of bombings around the city.

So far, rockets haven?t turned Tel Aviv into a ghost town like Israeli cities in southern Israel. Part of the reason is that none of the rockets have hit buildings so far, giving people more confidence to keep their daily routine.

"Has the world stopped?" asked Madaleine Koger, a retired shopowner, who was forced by a siren to interrupt a bike ride on the sea promenade to take cover in a hotel basement. "For this I should stop all of our life?"

A genuinely funny and touching film that, in less than a decade, has established itself as a timeless classic.

It makes even more compelling what is still my all-time favorite Pixar film.

Think of this re-release as an encore, a handy touchstone for you and your kids. "Finding Nemo" was and remains the gold standard against which all other modern animated films are measured, a classic from the day it premiered.

In this seamless blending of technical brilliance and storytelling verve, the Pixar team has made something as marvelously soulful and innately, fluidly American as jazz.

Nemo, with its ravishing underwater fantasia, manages to trump the design glamour of earlier Pixar films.

Detail is what holds your attention from frame to frame: the panorama of soft and hard corals, the different textured sea bottoms, the undulating seaweed, and the schooling sardines that look flashy and real as can be.

I don't exactly worship Pixar, but "Finding Nemo" is truly a great film.

Gill is Platoon's Sgt. Elias if he'd survived Sgt. Barnes' treachery and returned to civilian life weary and hard-bitten from his experiences. And also a fish.

Finding Nemo 3D is a quality post-conversion experience that successfully enhances the 2003 film's original standout visuals.

The 3D gives the images a little more depth but they already had heft and weight. The 3D is a money-making gimmick, nothing more.

A great blend of storytelling and technology.

It's downright curmudgeonly to remain focused on the negatives when the rest of the picture is saturated with invention and wit.

It's bright, it's beautiful and it hasn't aged a day. So why, then, do we need to see it in 3-D?

A rare example of a movie that not only survives its 3-D conversion but benefits from it

It was as funny as I remember and brilliant because it is subtle. It just knocks it out of the park. I love everything about this movie, one of my favorite Pixar movies of all time, 5/5 Schmoes. The new sound/3D adds to the greatness that is Nemo.

If you're fishing for fun in an ocean of movie mediocrity, grab the kids or the grandkids, fork out a few extra bucks and see this one in three-dimensions.

It's a great movie, so much fun, an acheivement that should be enjoyed by children of all ages and worth seeing it in 3D.

Sea-worthy w/enhanced visual lure and rich, humorous characters set in a double narrative; this 3D revisit allows us to fall overboard all over again.

If ever there was a film that wasn't broke, this is it. So naturally they converted it into 3D for a special re-release this weekend. (Stupid irony.)

I believe my sensitivity to certain creative choices of the picture has dulled some, while age has opened my eyes to its complex relationships and tireless sense of exploration.

Five Things You Shouldn't Do to Improve Your Credit Score | Credit ...

When the U.S. economy tanked in 2008, consumer credit scores were among the victims of the collapse. Consumers who may have had mediocre credit scores before the downturn suddenly found themselves in the high-risk pool, thanks to job loss, tightening of credit restrictions and other factors. And those who had poor credit before are generally finding it more difficult than ever to improve their credit picture. As a result, many people find it difficult or even impossible to access new credit, from credit cards to mortgages ? or even get approval for purchases like cell phone plans or utilities.

The increased restrictions on the availability of credit have led some to take drastic measures in order to improve their credit scores. However, in the effort to increase that number, some consumers are making mistakes that actually make the problem worse. The following are some of the most common mistakes people make? have you made any of them?

1.???? Closing Old or Unused Accounts

This is one of the most common mistakes that people make when trying to improve their credit score. Many people mistakenly believe that having accounts that are paid off and no longer used on their credit reports is hurting them, when in fact the opposite is true. The formula for calculating credit scores takes into consideration the amount of unused credit you have compared to how much you owe. Therefore, if you have a credit card that?s paid off, your overall available credit increases, reducing your debt to credit ratio and increasing your score. If you have these types of accounts, keep them open to keep your score intact. To avoid having the creditor close the account for being dormant use the card once in a while and pay off the balance immediately to avoid incurring more debt.

2.???? Opening a Number of New Accounts

Just as closing old accounts can hurt you, so can opening a bunch of new accounts to try to increase your available credit. Every time you apply for a new account, it generates an inquiry on your report, which can lower your score by several points. If you open accounts and then use them, it also increases your overall debt and lowers your score. Instead, focus on paying down the accounts that you have currently. A history of consistent payments and a low amount of debt will increase your score in time, so even if you qualify for bad credit loans or high interest credit cards, don?t open the account unless you absolutely have no other option.

3.???? Cutting Out Credit Altogether

If your credit score and report are dismal, it might be tempting to just cut up the cards and pay cash for everything. While that might be a good short-term strategy to get out of debt, avoiding credit cards altogether can actually harm you in the long-term. Not only is living without a credit card impractical, using credit responsibly and paying off your debts will actually improve your score over time.

4.???? Enlisting the Help of a Credit Repair Company

There is a difference between credit counseling and credit repair. Credit counselors will work with you to develop strategies for you to pay off your debts yourself, and might negotiate with creditors to lower rates or eliminate fees. A credit repair company, on the other hand, will often promise to ?fix? or ?clean? your credit report and remove all derogatory information. The Federal Trade Commission notes that there has never been a legitimate credit repair company. Violence against women in Latin America: Is it getting worse?

Like the majority of women in Colombia, Viviana Hernandez won't leave her house without makeup. She applies a thick layer of foundation and outlines her slightly deformed lips with red liner. She draws in her eyebrows ? she lost her natural ones ? and hides the few lashes she has left and her disfigured eyes behind the large dark sunglasses that she's worn day and night since an attacker threw acid on her face five years ago.

Ms. Hernandez has no doubt it was her estranged partner who ordered the attack. Once she came out of intensive care at the hospital, she remembers him calling her cellphone, telling her that no one else would want her now but him.

Hernandez's is but one face of violence against women in Latin America, a worrying trend in a region that has seen enormous advances for women over the past decade. Forty percent of the region is now led by women: There are female heads of state in Brazil, Argentina, Costa Rica, Trinidad and Tobago, and Jamaica. Women have reached equal access to education and have increasingly joined the workforce. Awareness has also grown around the issues of violence against women through a spate of legislation aimed at protecting them.

But this progress stands in sharp contrast to gender-based violence that has long plagued the region, and is now manifesting itself in new and dangerous ways.

In some countries violence against women is far worse today, from a spike in femicides ? the gender-based killing of women ? in places like El Salvador and Honduras, where the drug war has become deadlier, to the disturbing trend of acid attacks against women in Colombia. In light of the Nov. 25 United Nations International Day for the Elimination of Violence Against Women, this uptick leaves many questioning what can be done.

Why target women?

Last April Nadine Gasman, the head of UNiTE to End Violence against Women for Latin America and the Caribbean, a UN initiative that fights impunity and works to change cultural attitudes, attended a meeting with police, prosecutors, and justice ministries across the region to talk about violence against women.

"What was clear is that there is an increased number of [acts of] exacerbated cruelty," Ms. Gasman says. "We don't understand why."

Violence against women is linked to a number of factors, including hard economic times and communities where violent crime is endemic. But Gasman, like many observers, says that part of the spike in several countries could be attributed to different paces of change in society: Women are reporting crime more, but justice systems are not responding, making them even more vulnerable.

"Women are asking for rights, and men get very violent; and because the system is so cumbersome and does not provide responses quickly enough, violence gets worse and worse," Gasman says.

Femicides in Mexico, Guatemala, Honduras, and El Salvador have all shot up in recent years, registering some of the highest rates in the world. The latter has seen the biggest spike in femicide in Latin America, with 637 women murdered in 2011, almost quadruple the rate from a decade ago, says Silvia Juarez, who heads the violence against women program for the Organization of Salvadoran Women for Peace.

Toys"R"Us Launches China Retail Site, Makes ... - The Next Web

With Christmas on the horizon, kids favorite?Toys?R?Us has made a big global ecommerce push after launching a retail site in China and hatching plans to introduce mobile-optimized sites and apps to 11 new markets, including the UK, Germany and Japan.

While the Western Christmas rush isn?t exactly replicated in China, a?Buddhist?country, the festivities and gift buying often spills out into Asian countries. However, more pertinently, the firm is the latest in a series of Western companies aiming to grab a slice of China?s increasingly lucrative ecommerce market, powered by its increasingly affluent middle classes and growing Internet access.

Perennial China struggler eBay linked up with local Web retailer Xiu.com this month, while October saw Walmart close a deal that increases its holding in B2C ecommerce player?Yihaodian to 51 percent.?Online retail sales in China are expected to hit $360 billion by 2015, China Daily reports, and the country?s answer to the US? Cyber Monday further illustrated the lure of the space for outsiders.

Market-leader?Alibaba?s range of online shopping sites?banked an incredible $3.1 billion in sales?on the ecommerce bonanza day, held November 11. That?s more than double the $1.25 billion that?comScore estimates?US Cyber Monday brought in last year.

With that in mind, it?s no surprise that Western firms are keen to open themselves up to China. The move from Toys?R?Us comes after a series of deals to increase its presence in China. The firm bought up a majority 70 percent share of its Greater China and Asia business from Fung Retailing?one year ago, and it currently operates 30 stores across China, having opened its first presence in Beijing three months ago.

The company isn?t solely focusing on China and it is also responding to the growth of mobile and tablets by preparing to introduce dedicated mobile websites and iOS and Android apps to give easier access for customers in?Australia, Portugal, Austria, Switzerland, the Netherlands and the UK. Those plans will also see it merge its flagship Toys?R?Us store with its toddler-focused Babies?R?Us website to allow visitors to ?navigate seamlessly? between the two.

?With the launch of our new ecommerce site in China and the addition of mobile shopping capabilities in our international markets, Toys?R?Us is more accessible now than ever before to customers around the globe,? said Jerry Storch, chairman and CEO of Toys?R?Us, Inc. ?These initiatives help us advance the company?s international growth and omnichannel strategies, while allowing more customers to shop with us whenever, wherever and however they choose.?

The company says its international ecommerce business has seen ?double digital growth? for each of the last two years, pulling in $1 billion in sales last year.

The growth plans come one month after Toys?R?Us introduce free shipping to 60 markets across six continents.

Castle: ?Probable Cause? | Law and the Multiverse

There are a lot of spoilers in this one, so we?ll cover the setup inside. But the issue we?re looking at here is the nature of the criminal offense of escape and its potential sentence under New York Penal Law

The deal here is that Castle has been framed for murder by an old nemesis, 3XK, from season 3. Beckett and the guys don?t believe it, but the evidence is incredibly incriminating and Castle himself has no explanation.

Of course, it?s a frame, and that comes out in the end. But before that happens, Castle is arrested and charged with murder. Actually charged: the DA makes an appearance and it is specifically mentioned that charges have been filed. Castle is to be transported to central booking for processing.

But the officers that come to take him over aren?t actually cops. They?re stand-ins hired to bust him out of the joint. When everything winds down, Gates says that while the murder charge is being dropped, ?There?s still the matter of your escape from custody. However, under the circumstances I?m sure you can negotiate down to time served.?

Escape is an offense under Article 205 of the New York Penal Law. Here we?re specifically interested in section 205.15(2), which makes it a class D felony to escape after one has been ?arrested for, charged with or convicted of a class A or class B felony?. The intentional murder of the victim was either second or first degree murder, depending on whether she was tortured prior to her death; either is a class A felony. ?So Castle?s escape would qualify as a class D felony.

If we look at Article 70, we see that class D felonies carry up to seven years hard time. Castle might well be able to negotiate down to time served given the fact that the DA?s office was about to try him on an epic frame job, but he might not either. Escaping from custody is, as the law provides, a serious matter. ?But I didn?t do it!? is not a defense to escaping from a legal arrest, even if it?s true. One does not have the right to resist arrest, escape from custody, or otherwise impede the criminal justice system simply because one is innocent.

This is actually kind of a big deal. Felony convictions are nothing to sneeze at, even if one can get it down to time served. This would go on Castle?s criminal record. He would trigger all sorts of red flags on background checks and security checkpoints. He might even run into problems with the guns he owns. If I were Castle, I?d try to negotiate that down from a felony to a misdemeanor. Call it escape in the third degree, which is any time one escapes from custody. That?s a Class A misdemeanor. This would still show up on a criminal background check, but misdemeanor offenses aren?t nearly as problematic as felony convictions.

Castle, the fake cops, and whoever arranged the escape will also have to deal with a potential conspiracy charge. ?The conspiracy charge would probably be conspiracy in the fifth degree because they conspired to commit a class D felony. N.Y. Penal Law ? 105.05. This is a ?mere? class A misdemeanor.

And what about Beckett, Ryan, and Esposito? ?They may be on the hook for hindering prosecution in the third degree, a class A misdemeanor. N.Y. Penal Law ? 205.55. That requires ?rendering criminal assistance? to someone who has committed a felony (as Castle did). ?Rendering criminal assistance can be a lot of things (see ? 205.50 for a list), but in can include ?deliberate non-disclosure of the identity of a known felon to the police during a criminal investigation.? ?People v. Williams, 20 A.D. 3d 72, 76 (Sup. Ct. App. Div. 2005). ?That case distinguished between ?the mere failure to report the commission of a felony to the police, on the one hand, and the affirmative act of concealing the identity of a known felon by false statement or material omission, on the other.? ?The former is not a crime in New York, but the latter apparently is. ?Beckett, Ryan, and Esposito?s concealment of Castle?s location may have been a material omission.

That theory is complicated by the fact that the police (i.e. Beckett, Ryan, and Esposito) were the ones doing the concealing. ?Beckett?s failure to disclose Castle?s location other information to Esposito during their first post-escape phone call probably qualifies. ?But after that the three of them are acting more as conspirators and less as people failing to disclose information to impartial police investigators.

Finally there?s the issue of the lawyer. ?It?s not clear who arranged the escape, but Castle was visited by his attorney, and he initially jokes that he escaped because of a ?great lawyer.? ?We doubt the lawyer arranged the escape as such, but he may have been used to pass information to whoever did arrange it. ?If the message was coded or concealed (e.g. in a sealed envelope), then that?s not a problem. ?But if the lawyer knew what was up, then that?s a big problem. ?As a co-conspirator he would be liable for the same felony as Castle, which means an automatic disbarment under?N.Y. Judiciary Law ? 90(4)(a). ?Even if Castle pleas down to a misdemeanor, the lawyer would still likely be disbarred or suspended.

Wedding trade expects boost from gay-marriage laws

PORTLAND, Maine (AP) - In the two weeks since Maine voters approved a law allowing same-sex marriage, Clay Hill Farm has been getting phone calls and emails from gay couples inquiring about open dates and wedding packages at the restaurant and wildlife sanctuary, a popular wedding spot in York.

The law won't go into effect for more than six weeks, but already couples from in and out of state have called, said Jennifer Lewis-McShera, who heads the wedding department there.

Clay Hill Farm puts on dozens of wedding ceremonies a year, as well as receptions and rehearsal dinners, and provides catering services to wedding parties at other locations. Legalizing same-sex marriage can only help, Lewis-McShera said.

"It will increase business in this area because we'll attract more couples from Boston and the New York metropolitan area who now can have the wedding of their dreams in Maine," she said. "This puts Maine on the map."

Add the coast of Maine, the banks of the Chesapeake Bay and the shores of Lake Washington to gay wedding destinations. Next month and in January, laws go into effect in Maine, Maryland and Washington that allow same-sex marriage. They're the first states where voters approved such laws, rather than legislators or courts.

Nearly 18,000 same-sex couples in those states will exchange vows in the first three years after the new laws are in effect, estimated The Williams Institute, a national think tank at the UCLA School of Law, and the laws should generate at least $166 million in wedding spending in the three states over the next three years from in-state couples alone, boosting tax revenues and creating new jobs.

Wedding-related spending for in-state couples is projected be about $16 million in Maine, $63 million in Maryland and $89 million in Washington.

The numbers go up when figuring in out-of-staters who travel to those states to be wed. In Maine, for instance, the new law could boost the state economy by $25 million and create up to 250 new jobs in the coming three years, said Lee Badgett, research director at the Williams Institute and an economics professor at the University of Massachusetts.

So many people have ties to Maine through vacations, summer camps while growing up or seasonal homes, said Portland wedding planner Diane York. A lot are attracted to Maine for weddings and receptions because of its beaches, old New England churches and lighthouses, such as Portland Head Light in Cape Elizabeth, which went into service in 1791 and has been called one of the most-photographed lighthouses in the country.

"Now Maine will be able to make its case: This is beautiful, you should come here to get married," Badgett said.

The average cost for a wedding nationally is about $27,000, and about $2,000 less in Maine, York said.

Other states that have legalized gay marriage have benefited economically as a result. Same-sex marriage is legal in Connecticut, Iowa, Massachusetts, New Hampshire, New York, Vermont and the District of Columbia.

Vermont and Massachusetts now include sections on their state tourism websites that include information about gay marriage. Even honeymoon capital Niagara Falls has gotten a lift from same-sex weddings and honeymoons.

In Maine, Pam Remy of South Portland and her partner of 13 years, Karen Weiss, have just begun to plan for a late summer or early fall wedding. They're looking into pastoral settings in southern Maine to host the wedding and are hoping to have up to 200 guests.

The to-do list is the same that same many couples face when planning a wedding: find a venue, print invitations, hire a photographer and arrange for food and entertainment. Remy, 44, says they have to find a place soon because venues are being booked quickly.

"I imagine this wedding will be the whole shebang," Remy said.

Cindy Sproul co-owns North Carolina-based Rainbow Wedding Network, which produces gay and lesbian wedding expos in Seattle and other cities. Just since the election, she's seen a 30 to 40 percent increase in companies wanting to advertise with the company in Washington state.

Thousands of in-state residents, as well as those from nearby states that haven't legalized gay marriage, are expected to exchange vows in Washington in the coming years.

"There are a lot of couples that will cross state lines to get married. Maybe they want to make a long weekend of it," Sproul said. "I imagine there will be couples from Oregon who will come up."

In Maine, a Portland man has launched what he's calling the first online wedding directory, http://www.gayweddingsinmaine.com , connecting same-sex couples with gay-friendly businesses. Sid Tripp, who owns a marketing company and is president of the DownEast Pride Alliance gay business networking group, said Maine's new law should benefit such companies as tuxedo rental shops, caterers, florists, photographers, jewelers, limousine services, musicians and DJs.

"Maine has positioned itself as a progressive, forward-looking state that is welcoming to everybody," Tripp said. "The gays will see this as a sign of solidarity with them, and they'll be coming here in droves wanting to get married."

Buddhist Psychology Treatment Plan for Perfectionism | 360 ...

Nan Tien Temple Buddha among the lotus plantsIf perfectionism is a form of hunger (for approval/validation, reflection/attention, control/certainty), then how can we satisfy this hunger, how can we feed it?? The answer is: with the bread of acceptance!

Borrowing the language of the?four noble truths from Buddhist psychology, I offer the following treatment (?self-feeding?) plan:

  1. The experience of reality as imperfect (i.e. dissatisfaction with reality the way it is) exists and is inevitable;
  2. The source of this suffering/dissatisfaction is a desire or an expectation for reality to be different from how it is, to be better than it is; i.e. the source of perfectionistic suffering is the striving to perfect what is;
  3. Perfectionism can be helped through the acceptance of the reality for what it is, in its perfectly imperfect suchness.

How?s this acceptance achieved?

The short answer is: by a) redefining the meaning of perfection and b) through mindful living (as a consciously-chosen philosophy of living) that allows you to recognize the ordinary perfection of what is.

The long answer is a curriculum of experiential precedents that I detailed in my 2010 book, Present Perfect.

As for redefining perfection, it is a matter of two paths ? one dualistic and the other non-dualistic.? The first, dualistic,? strategy allows you to shift from a state-view of perfection to a dynamic/process-view of perfection ? a relatively straightforward process that is easy to read about but requires a certain experiential homework to sink in.? The second, non-dualistic, strategy for reframing perfection is more nuanced: it completely collapses the distinction between perfection and imperfection.
